1. What PController is

PController is an application that allows a PC to be controlled remotely from a phone's browser. It works by installing a client on the PC and connecting from the browser or the mobile app.

4. Authorisation over linked devices

By linking a device to their account, the user declares and warrants that they own that device or hold express authorisation from its owner to install the client, control it and access it remotely. This declaration is understood to be renewed with every device the user links and every control session they start.

The user is solely responsible for the lawful use of PController's remote-control capability, both in respect of the devices they link and in respect of anyone who may be affected by that control. PController does not verify, and has no means of verifying, ownership of or authorisation over linked devices; that verification is the user's responsibility alone.

The user is responsible for keeping their account secure. In the event of unauthorised access, they must notify hello@pcontroller.app immediately. The password and the session token must not be shared with third parties.

8. Service availability

PController makes its best effort to keep the service available, but does not guarantee 100% uptime. The service may be interrupted for maintenance, updates or causes outside its control.

9. Indemnity

The user shall hold harmless PController and Alejandro Neira, the natural person operating the service, against any claim, demand, investigation, penalty, loss or expense —including reasonable legal fees— brought by a third party and arising from: (a) use of the service in breach of these terms or of applicable law; (b) access to, control of or monitoring of devices without the authorisation required in section 4; or (c) acts carried out through the user's account, including by another person who gained access to it, where that access resulted from the user failing to protect their credentials as set out in section 5.

This obligation survives termination or deletion of the account. Nothing in this clause limits or excludes the non-waivable rights Colombian law grants the user as a consumer.

10. Limitation of liability

PController is provided "as is". To the maximum extent permitted by Colombian law, PController is not liable for indirect damages, loss of profit, loss of data or any damage arising from the use of, or inability to use, the service.

Nothing in this section excludes or limits liability that, under Colombian law, cannot be excluded or limited, in particular the non-waivable rights granted to consumers by Law 1480 of 2011. The limitations above govern only the relationship between PController and the user; they have no effect against third parties who are not party to these terms, whose relationship with the user or with PController is governed by the general rules of liability.

11. Intellectual property

PController and its components are the property of Alejandro Neira. The desktop client installed on the PC is proprietary code licensed for personal use. Redistributing it without authorisation is not permitted.

12. Termination

PController may suspend or terminate an account if the user breaches these terms. The user can delete their account at any time from app.pcontroller.app/account (step-by-step guide).

13. Governing law

These terms are governed by the laws of the Republic of Colombia. Any dispute will be resolved in the competent courts of Colombia.
